The Personal Property Security Act 2009 (PPSA) regulates all forms of security interests, of which is broadly defined by the Act; these interests must be registered to maintain their enforceability. The Act covers both tangible and intangible property. We can assist with the preparation and advice for leasing and licensing arrangements of personal property (including related party), credit applications and retention of title, sale of assets, loan and security arrangements and due diligence and release of security interests.
Owning property using smsf
The Superannuation Industry (Supervision) Act 1993 and regulations allow for the investment of self-managed superannuation funds (SMSF) in property. We work with our clients and their advisers in providing advice and then implementing compliant structures that allow for the investment of superannuation in business real property utilising any one or more combinations of superannuation, borrowed funds from either a third party financier or related entity, non SMSF funding through geared and ungeared unit trusts and limited recourse borrowing arrangements.
